This week Mark Porter looks at the regulation covering medical devices and implants - everything from artificial joints, to pacemakers and heart valves - and explains why more needs to be done to protect the general public who are often unwitting guinea pigs for untried technology.

He asks why is it so much easier to get approval for devices like new hip or breast implants compared with the strict protocols observed for drugs? All you need for most devices is the equivalent of the CE mark - the sort of approval you would expect to find on a toy or a kitchen appliance, not a pacemaker - which may explain why some have unacceptably high failure rates.

Medical device regulation 'putting patients at risk' Health secretary Andrew Lansley is to make another statement in the Commons about what the NHS can do to help women who had PIP breast implants and are worried about the risk of rupture.

Dr Richard Horton, editor of the Lancet medical journal, details an editorial in which concerns are raised over regulation of all medical devices.

"We have a smokescreen of device regulation which is, unfortunately, putting patients and surgeons at risk," he said.

Department of Health Letter sent to TVT Mum
We received a four page letter from the Department of Health answering all the concerns within the document sent to the Prime Minister. TVT Mum is mentioned in the DH letter - 'Websites such as TVT-MUM can also help to increase awareness. The recent increased awareness of this problem is resulting in an increase in the number of reports, helping the MHRA with their assessment'

In February 2012, the MHRA commissioned an independent review of all current and up-to-date evidence on the use and potential problems associated with both vaginal tapes and mesh for stress urinary incontinence and pelvic organ prolapse. This is expected shortly. We will publish the findings of this research as quickly as possible so that surgeons and doctors can give the best information possible to patients about the benefits and risks of this type of surgery.

This was an extremely helpful meeting and allowed me to understand much better the extent of the problems that we face in relationship to these devices.

It seems to me that there are a number of serious issues here in relationship to both the devices and practices and I will be discussing these and feeding these into our workshop and particularly with the clinicians involved in the workshop, who as you know include Marcus Drake, Chris Chapple and Sohier El-Neil.

We are obviously going to have to take a number of actions and I will keep you up to date with exactly what is happening. Thank you both very much for taking the time and trouble to talk to me and provide this information. There is absolutely no doubt in my mind that we have an issue which was much wider than we as the Regulator had understood.

We are not considering issuing a Medical Device Alert on vaginal tapes and mesh as we do not have enough evidence to indicate the problem is with the mesh devices being unsafe, as opposed to a failure of the surgical procedural involved in implanting them. Although as you are aware we continue to review this situation and to investigate all incidents and clinical evidence with the tape and mesh manufacturers.

With regard to the outcome from the recent workshop, we hope to have the notes of our recent workshop on our website as soon as they are finalised and agreed with all the participants who attended.

We are endeavouring to ensure that the MHRA website pages are as up to date as possible with any developments related to the safety of vaginal tapes and meshes so that surgeons and doctors can give the best information possible to patients about the benefits and risks of this type of surgery. I think we are moving forward. The clinicians on our Expert Advisory Group have been attending a meeting in America where this has all been discussed and I really feel that we have done a lot, with your help, to bring to the fore the problems with these devices. Together with the Professionals we are designing, information will put on our website with regard to what patients should be asking their surgeon prior to deciding on these procedures. Hopefully soon we should have up on our website the systematic review that we have had carried out with regard to a number of issues associated with these procedures but in particular the incidence of adverse events so that again patients considering these procedures can take a decision in the light of up-to-date information.

I thought you would also like to be kept up to date with what is happening at this end. As you know one of our frustrations as Regulator is that we often cannot help many patients such as yourself with clinical symptoms and problems because we are not clinicians and essentially these queries and issues need to be fed back to the doctors responsible.

This is a point I have made very firmly with our experts in this area and they have taken this on board such that one of our experts is bringing this up with his Professional Body to ensure for the future there is some mechanism in place where patients can phone in/contact to have their queries answered or indeed be directed to the appropriate person.

I think this is the first time that I have ever know such an initiative to happen so congratulations to you for pushing this forward.

A recent Development at the MHRA
There will be a forthcoming meeting at the MHRA in the very near future with the Department of Health, the Royal Colleges and Professional Bodies and the Commissioners who commission hospital treatments for patients.

I put in a request for an invite to attend the meeting and then I received a response to say the meeting will be very much internal in the first instance, however, the MHRA would like us included by way of submitting a list of concerns we have on Vaginal Tapes and Meshes to be forwarded to the Commissioner.

The MHRA also mentioned they think it's very important that friends and colleagues understand that they have not stood still on this one but are trying to do the absolute best for patients.

News from the MHRA

Dear Lorraine:
This is just to let you know that there was a very successful meeting the other day between one of the new Commissioners, representatives of the Professional Bodies and Royal College of Obstetricians and Gynaecologists, the Department of Health and MHRA concerning the above. This took into account the concerns of patients about these devices which were openly discussed.

There was agreement that there needed to be actions by all parties so that we could keep a careful eye on these issues, ensuring best practice for patients.

There is going to be a press briefing within the next week to 10 days and I will let you know exactly when this is going to be. In the meantime it was acknowledged that the reports from you and your friends and colleagues on adverse events had been extremely helpful in bringing this issue to our attention and that MHRA wanted to promote the future onward reporting of all adverse events so that we can keep an eye on the problems and further discuss with the Professional Bodies as indicated.

I hope that you will recognise that you and your organisation have done a tremendous job in bringing about raising of the profile of this important issue and bringing about changes in practice.

The Medicines and Healthcare products Regulatory Agency (MHRA) today urged healthcare professionals and the public to give their views on new draft European laws for the regulation of medical devices such as breast and hip implants and hospital equipment, such as dialysis machines. Medical device regulation continues to be a hot topic of debate following PIP breast implants and the recent safety concerns involving metal-on-metal hips. The MHRA has been pressing the European Commission to strengthen the current European system of regulation for four years and we have now launched a ten-week consultation so that healthcare professionals and the public can give their views on whether new draft legislation from the European Commission goes far enough in the following areas...
